ERISA class actions are on the march. Since 2019, hundreds of new class actions alleging mismanagement of 401(k) plans have been filed against companies of all sizes in virtually every industry.  Exposure in these cases can be massive:  the top 10 ERISA settlements in 2021 alone totaled more than $800 million.  Early this year, the U.S. Supreme Court issued an opinion—Hughes v. Northwestern University—that means more cases will follow in 2022.  This panel will share practical considerations and actionable tips for how companies can prepare for one of these cases and their particular challenges and opportunities.
