Description

California notoriously has some of the country’s broadest consumer protection laws. The leader of that pack is California’s Business and Professions Code Section 17200, also known as California’s Unfair Competition Law (UCL), which prohibits any unlawful, unfair or fraudulent business act or practice. It also prohibits unfair, deceptive, untrue or misleading advertising. In this panel we will explore the fundamentals of UCL claims and its companion statutes, California’s Consumers Legal Remedies Act (CLRA) and False Advertising Law (FAL), and provide an overview of recent trends where courts have started to provide some guardrails on class actions premised on these three statutes.
